10.6.1 Purpose: The Town of Portland has conducted an inventory of historically and/or architecturally significant sites and structures which are identified on the Historic Resources Plan (HRP) located within the Town of Portland Plan of Conservation and Development (POCD). The purpose of the adaptive reuse provisions of these Regulations is to foster the restoration and renovation of these significant buildings and structures which have value to the community and to preserve and adaptively reuse them by incorporating them into new development and/or change of use proposals to the fullest extent feasible.
10.6.2 Procedure: When any development or change of use proposal includes one or more sites or structures identified within the HRP, the applicant is required to submit an application to the Commission is accordance with ZR Section 10.4 (Special Permit Standards and Procedures). The Town shall refer the application to the Portland Historical Society at least 30 days prior to the public hearing for its review and comment.
10.6.3 Criteria: The Commission shall consider requiring adaptive reuse when:
A. There is historic, architectural, cultural, economic or other value to the Town to justify renovation and preservation, as determined by the Planning and Zoning Commission.
B. The long term benefits of the proposed adaptive reuse outweigh any negative impact on the neighborhood of the proposed project and on the Town as compared with the alternative of having the structures demolished or remaining vacant or under-utilized.
10.6.4 Performance Standards: The following standards are required:
A. The proposal incorporates the existing building(s) or structure(s) in the present location, or includes a proposal for relocation which is found to be as suitable and appropriate as the present location.
B. The renovation and remodeling of buildings and structures for adaptive reuse may not destroy or obscure essential architectural features. In addition, such architectural features must be maintained and enhanced to the extent that it is feasible and prudent to do so.
C. In cases where buffer areas cannot be provided on the site, any area available for landscaping shall be so utilized. When the Town or State grants permission, the owner or developer must also use areas within the public right-of-way to satisfy landscaping requirements.
D. Where necessary parking cannot be provided on site, reasonable provision for parking shall be provided off site.
10.6.5 Waivers: The Commission may waive any/all applicable zoning regulations to support adaptive reuse when requested by the applicant in writing, except that no use shall be permitted which is not allowed in the applicable Zone.

Pursuant to Section 503(i) of the Town Charter, a public hearing will be held by the Board of Selectmen on Wednesday, March 4, 2009 at 7:00 P.M. in the Public Library to provide residents the opportunity to comment both orally and in writing on the adoption of the proposed draft ordinance “Implementation of the Provisions of Section 9-204b of the Connecticut General Statutes Regarding Non-Restrictive Voting for Members of the Board of Education.”
The Town of Portland hereby adopts the provisions of Section 9-204b of the Connecticut General Statutes in order to implement non-restrictive voting at elections for members of the Portland Board of Education. Accordingly, each political party shall have the right to nominate as many persons as there are vacancies on the Board of Education and those names shall be placed upon the ballot. Whether the number of members to be elected is odd or even, any elector may vote for all of that number and the persons receiving the greatest number of votes shall be elected, except that when the number of members of any one political party who would be elected without regard to Section 9-167a of the Connecticut General Statutes exceeds the maximum number as determined by that section, then only the candidates of such political party with the highest number of votes up to the limit of such maximum, shall be elected. The next highest ranking candidates, not from such political party, shall be elected, up to the number of places to be filled in such election.
A copy of the proposed ordinance is on file in the Town Clerk’s office and is available for public inspection.
